一、上海亿发餐饮娱乐有限公司与陈某等身体权纠纷上诉案
【裁判要旨】
娱乐场所及其从业人员不得为进入娱乐场所的人员提供以营利为目的的陪侍活动。娱乐场所容留并放任他人为进入该所的人员提供以营利为目的的陪侍活动的行为，系违法行为，该行为是以损害陪侍人员的生命、健康为代价的。故，娱乐场所对于陪侍人员在其经营场所内因饮酒过量而死亡的损害后果具有一定的过错，应当承担相应的侵权责任。另外，陪侍人员本人应对其死亡的后果承担主要过错责任，参与不当劝酒的顾客也应承担次要过错责任。
[Judgment Abstract]
Entertainment venues and their staff should not provide profitable accompanying services for their customers. It is illegal for an entertainment venue to take in and allow others to participate in profitable accompanying services, given that this act is at the cost of the service providers' health and life. Therefore, the entertainment venue is partially liable for the service provider's death of insobriety and should assume corresponding tort liabilities. Furthermore, the service provider herself should take primary responsibility for her death, while the customers with drink-urging misconduct should assume secondary liabilities.

【裁判摘要】
从本质上讲，自发式户外运动在组织阶段，并不属于法律行为，而属于社交层面的情谊行为，故相约者之间并不负担必须履行的义务。不过，一旦进入实际参与阶段，相约者之间的关系就会发生变化，相互之间即产生侵权法上所要求的注意义务，其中，对于组织者而言，其负有的是安全保障义务；对于参加者而言，则是基于诚实信用原则而产生的帮助义务。组织者和参加者一旦违反上述注意义务，则此前的社交层面的情谊行为就会转化为情谊侵权行为，因此而造成的损害，二者均应承担相应的赔偿责任。
[Judgment Abstract]
In effect, the voluntary outdoor activities at the stage of organization cannot be identified as juristic acts, but acts under the friendship at the social interaction level, to the extent that the persons making the appointment do not need assume any obligation toward each other. However, once they actually participate in the activities, the organizer should bear the responsibility for safety guarantee while participants should bear the responsibility for mutual assistance under the principle of good faith. If any organizer or participant defaults on his or her responsibilities as mentioned above, the acts under the friendship at the social interaction level will turn into tortious conducts under the friendship, and damages incurred therefor should be compensated by both the parties concerned.

【裁判要旨】
对水塘等公共资源有安全管理义务的行为人或集体组织，未设置安全防护措施及警示标志，对事故的发生有过错，应承担赔偿责任。法定监护人放任未满三周岁，对危险尚未有足够认知的无行为能力人独自在水塘附近游玩，未尽到监护责任，应对溺亡后果承担主要过错责任。
[Judgment Abstract]
Where an actor or a collective organization having the safety management obligation for ponds and other public resources fails to set up safety precautions and warning marks, it should be deemed that they are at fault for the occurrence of the accident and therefore assume the compensatory liability. The legal guardians of the child should assume major fault liability for the child's drowning due to their failure to fulfill guardianship, indulging a legally incompetent person under the age of three who's yet to acknowledge the danger of playing by a pond by himself.
