PSC无限期滞留,船员被遗弃!什么情况?
一、SOUTHERN STAR(8796734),滞留12天(8.21-9.03),10项滞留缺陷
缺陷解读
1、NO FLAG STATE ENDORSEMENTS OF COC FOR REQUIRED SHIP CREW ACCORDING TO THE MINIMUM SAFE MANNING DOCUMENT. 2/E DID NOT HAVE MEDICAL CERTIFICATE (NO SHIP CREW HAD THE REQUIRED COC TO REPLACE HIS POSITION).船上没有配备兼职医生
公约依据:Standard A4.1 – Medical care on board ship and ashore
(c) Ships which do not carry a medical doctor shall be required to have either at least one seafarer on board who is in charge of medical care and administering medicine as part of their regular duties or least one seafarer on board competent to provide medical first aid; persons in charge of medical care on board who are not medical doctors shall have satisfactorily completed training in medical care that meets the requirements of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended (“STCW”); seafarers designated to provide medical first aid shall have satisfactorily completed training in medical first aid that meets the requirements of the STCW; national laws or regulations shall specify the level of approved training required taking into account, inter alia, such factors as the duration, nature and conditions of the voyage and the number of seafarers on board; and
2.油类、垃圾记录簿无记录,无sopep、加油单,这种缺陷理论上是要罚款的,不知道香港PSCO如何处理。消防系统瘫痪,人员素质低,30分钟才能集合人员,连接消防皮龙。
从上面缺陷看,该轮人员素质低,管理很差,无论从哪个角度看该轮的SMS体系没有有效运行,为何PSCO没有开具体系审核缺陷呢?这跟9114050(HONG SHENG 01)的情况形成了对比。
二、9114050(HONG SHENG 01),滞留7天(8.24-8.31),4项滞留缺陷
缺陷解读
1. DISINFECTANT OF SEWAGE TREATMENT PLANT WAS NO STOCK ONBOARD AND THE DOSAGE TUBE OF DISINFECTANT IN THE PLANT FOUND EMPTY.生活污水没在船上存放,而消毒管内没有投放药品。显然这个缺陷会造成生活污水处理不达标,有的船员选择在厕所内投放药品的方式,是不可取的,应按照说明书的要求在规定的位置投放药品。
2. SMS运行失效,根据多项缺陷推断体系失效,是可以的,显然SOUTHERN STAR(8796734)的情况要严重于这艘船舶,为何上艘船舶没有开具ISM缺陷,PSCO能否解释下。
三、无限期滞留两艘
8526672(PRINCE DELIGHT),8月15日被滞留后,依然停靠在香港海域,3项滞留缺陷
这艘船,配员不足,人员不适任,生活污水非法排放,实在是破船中的极品,提请各位不要在这艘船上工作
8810401(SEALINE 2),8月21日被滞留后,依然停靠在香港海域,7项滞留缺陷
四、船舶被遗弃,船员怎么办

目前情况不确定,假如照此情形,如船东弃船不顾,船员应如何操作?如何避免损失?
对于船员遗弃问题,长期以来没有一个很好的解决办法,MLC公约尝试给了一个答案,尽管不明确,却可以参照执行,各位船员朋友可以以此为依据进行维权
公约依据:Regulation 2.5 – Repatriation (目的:确保海员能够回家)
1. Seafarers have a right to be repatriated at no cost to themselves in the circumstances and under the conditions specified in the Code. (在守则所规定的情形和条件下,海员有权利得到遣返而不向他们收取费用)
2. Each Member shall require ships that fly its flag to provide financial security to ensure that seafarers are duly repatriated in accordance with the Code. (各成员国应要求悬挂其旗帜的船舶提供财政担保以确保海员根据守则得以合理遣返。)
Standard A2.5.2 – Financial security (第一修正案,2017.01.18生效)
根据公约要求,一旦船员被遗弃存在船东不履行遣返义务、两个月不支付工资、不提供生活必需品、连续工作超过12个月等情形,船员便有权要求进行遣返。如船舶交纳了财政担保(nancial security),按照保险的跳进即可申请遣返。如未交纳,在船东不负担遣返费用的情况发生时,《MLC2006》规则部分规定船员可通过向船旗国、遣返国和船员提供国请求安排遣返 。
具体实施起来
1、如无欠薪问题或欠薪在2个月之内,按照财务担保的要求,可以自然解决。如欠薪额度过大,船员可向当地海事法院申请扣押船舶,并就船员劳务纠纷对船东提起诉讼。
2、一般遗弃船员伴随着欠薪,船东船都不要了,自然会抵押给银行等,唯一可行的是拍卖船舶,在拍卖前应确定船舶拍卖款中优先受偿顺序。船员作为弱势群体,应提前设计方案。
3、维权成功。
